An assault is a physical, emotional or verbal attack against another person. The highest punishment is given to those who commit physical attacks with a weapon, which is aggravated assault. The degree of injury to the victim and the intent of the perpetrator also influence the seriousness of the crime. Assaults can result in serious physical and emotional injury. Assaults do not have to result in physical violence; a threat is enough to constitute a crime.
Assaults come in many forms, including:
- aggravated assault
- with a weapon such as a gun, knife, or other object used to cause injury
- sexual assault
- rape, verbal sexual assault, gestures, visual sexual assault, or anything that forces a person to be involved in any way in unwanted sexual behavior
- domestic assault
- This involves violence against family members or couples who are cohabitating. Domestic assault could be in the form of threats or physical violence.
Aggravated assaults are frequent; there are more than 800,000 aggravated assaults committed each year. Most assaults are committed with hands, fists, feet and other body parts striking the victim. The next most frequent are with firearms, then knives, then other weapons. Aggravated assault is treated as a felony, which means it is a very serious crime that is punishable by more than a year of jail time.
Sexual assaults are frequent as well; occurring every two and a half minutes somewhere in the U.S. Eighty percent of victims are under the age of 30, and the majority are women. Sexual assault is also prevalent in child abuse and physical elder abuse cases. Sexual assaults are often committed by trusted friends or family members, or people who the woman has met before. Domestic assaults happen in the home between family members or cohabitating partners. Domestic assaults are frequent also; there are almost 3 million cases per year. Many go unreported because of fear of retaliation and further assaults. The majority of the victims are women and children (more than three women are killed per day in the U.S.), although men can be victims too (more than one man is killed per day by an intimate partner). Domestic assault and sexual assault often overlap; 76 percent of women who report being raped since the age of 18 say a cohabitating partner or husband committed the rape.
If you are the victim of an assault of any type, the first step is to immediately seek medical attention, then contact a personal injury attorney who can answer any questions you have and help you seek compensation for your injuries and suffering.
