Defective Firearms

Defective firearms can cause serious injury. As many as 3,000 children are killed each year in gun accidents, and although defective firearms do not cause all these deaths, they certainly don’t decrease the problem. In a recent case, one teenager received serious brain injury when his BB gun malfunctioned.

The gun was recalled because even when it appeared to be unloaded, BBs hidden in the chamber would drop into place, waiting to be fired. The exact number of people who are injured and killed by defective firearms each year is unknown. Almost 20,000 are treated for injuries each year, and for many of those cases, many experts believe there would not have been injuries if the gun had been more conscientiously designed.

Other recent cases include:

  • An 8-year-old boy who was accidentally shot in the face by another child. He received serious brain injury. The gun was found to have a failed safety device, it did not have a loaded chamber indicator, and it was not childproofed.
  • A 15-year-old boy’s older sister accidentally dropped a handgun, which fired and killed the boy.
  • A man was killed when his gun fell to the ground and discharged. The same gun killed the man’s cousin three years before, when the gun was struck against a tailgate.

Firearms are defective for many reasons, including:

  • faulty ammunition
  • safety system defects
  • explosions
  • fire control system defects

Keep yourself and your family safe by:

  • unloading and locking up all guns
  • store ammunition separately from the guns
  • keep the keys in a well-hidden place where kids won’t accidentally stumble across them
  • talk about gun safety; tell your kids what to do if they are at someone else’s house and a gun is present
  • teach your children how to safely handle a gun if you do have one in the house and/or teach them they are absolutely not allowed to handle a gun without you present
  • before letting your children visit someone else’s house, ask if there are guns present

If a defective gun injures you or a loved one, contact a personal injury attorney who specializes in defective gun cases. You may be compensated for medical expenses, pain and suffering.
