Don’t Be Liable for Slip and Fall: Sprinkle That Ice Melter!18 Nov Posted by: Cara in: Adverse Events, Injuries Ice and snow removers like salt blends can cause substantial damage to your driveway or walkway. It can create cracks and slowly erode the cement, resulting in a hefty cost to your pocket book, but someone slipping and falling on your property can cause you much more than that. With winter setting in, the likelihood of someone hurting themselves on your property increases drastically, and you will owe them more than an apology. The owner of a store or house is liable for anything that can be potentially dangerous, like black ice or wet steps from melting snow. You are liable for any unsafe condition if you allow it to exist on your land or property for an unreasonable amount of time. In other words, if you are clearly being negligent you can expect something to occur eventually.
People who have fallen on ice have filed many lawsuits. It is not uncommon and can happen to anyone. If someone falls on your property, you should immediately seek legal help if the person was injured and they are likely to make a claim that it was due to your negligence. You would want to write down and document all of the circumstances of the fall, such as if there was alcohol involved, or if the person was distracted or carrying a lot of items. Also, record the time and date of the incident, as well as where it occurred and if possible, photograph the area of the fall. It is much better to be over prepared just in case a lawsuit does occur than have to recall the incident from memory.
Of course the best method for winning a slip and fall lawsuit is to never have one occur, and in order to accomplish that there are a few things to remember. First, purchase ice melt. Many people complain it can damage their driveway or will get on their cars, fading the paint, but again, a slip and fall lawsuit can result in a loss of thousands of dollars.
Also, one of the main requirements for a lawsuit to occur is for the problem to last an unreasonable amount of time, so be proactive and if a storm strikes, be ready to shovel your driveway and sidewalks the next day. Snow is the easiest to remove when it is fresh, as opposed to when it partially melts and refreezes.
Even if you own a small piece of land or have a tiny sidewalk, the potential liability is still there. The injury caused does not even have to be that extreme, the victim simply needs to show it caused them physical or mental damages to have a case, so as the cold weather opens the door for all kinds of liabilities, take preventative measures on your property, and also be prepared to defend yourself if an accident does occur.
