Black Friday is crazy. Stores open at midnight, offering outrageous deals, and people line up ready to rush in and grab whatever they can. This year Black Friday gave people another reason to call it Black Friday, as a Wal-Mart employee was trampled to death as shoppers were ready to “blitz” the store. A good deal is great, but it is not worth trampling someone. How did these shoppers not notice there was a man on the ground, and moreover why did Wal-Mart promote this to such extents that one of their employees was killed? The question now is who is liable and how can we prevent this in the future. It is clear that Wal-Mart is at least partially to blame for this monstrosity. It seems that their negligence and inconsideration for the idea that they would need more employees and security guards is to blame. This man’s family to recoup their losses will most likely sue Wal-Mart. An employer is responsible for keeping a workplace safe, and they clearly did not do that.
Some may argue that the rushing hordes of shoppers are to blame, but how can you prosecute thousands of people? The shoppers are there because of the deals being promoted by the store, so it could come back to Wal-Mart this way as well. Still though, no matter how good of a deal a store may offer, that offer does not justify killing a man, and the customers, not the store itself, did kill this man. If there were an instigator for the mass rush, then they would be liable, like someone yelling fire in a crowded place, but no reports of someone like that have come out.
Wal-Mart is most likely going to take the fall for this, since it is their responsibility to provide a safe work place for their employees, but this needs to be seen as a wake-up call to the American population. In order to prevent something like this from happening again some regulations need to be put into place. For instance a law that states no more than 30 people may enter a store per minute.
It will be hard to completely stop events like this from happening though because we are so driven by consumerism. We have to have the latest technology and keep up with the Jones’s. If it takes lining up at midnight and fighting the crowds than so be it. Americans are driven by consumerism, but maybe we will be able to tone it back and realize what we are doing before another person gets killed.
